Applicability of This Privacy Notice to Our ecoText Platform.
This Privacy Notice describes the practices of ecoText, Inc. (“we”, “us” or “our”) with respect to personal information we collect from and about users (“you”, “your” or “users”) of our websites (including ecotext.co) (the “Sites”), software applications, including cloud-based and mobile applications (the “Apps”), application programming interfaces (the “APIs”), and features, functionalities and services provided through the Sites, Apps and APIs (collectively, together with the Sites, Apps and APIs, “ecoText” or the “Platform”).

Who We Are.
We are a company passionate about providing an innovative software platform that, through partnerships with publishers and content creators, enables students and professors to take advantage of educational tools and an extensive library of academic content.
Some of the personal information we collect and process is in connection with the Platform we provide to our users pursuant to our contractual arrangements with them. In these contexts, we are acting as a “data processor” only (please see details under Class Personal Information).
In other contexts, such as when you visit the ecotext.co website, register for an ecoText account, sign up for an ecoText subscription plan, or provide us with your contact or billing information, we are acting as the “data controller” because we are making the decisions about what personal information is collected and how we use that information to fulfill our business purposes.
Our privacy practices, and the rights you have with respect to your personal information, are dependent on whether we are acting as data processor or data controller with respect to that information.
Class Personal Information.
Access to any Class within our Platform is only available to Registered Users pursuant to the contractual arrangement between us and the Professor and/or school associated with such Class, pursuant to which the Professor and/or school, and not us, acts as the “data controller” who makes decisions about what personal information is collected and how it is processed within the Class. Personal information collected in this context could include, for example, academic information and communications that Professors and Students elect to store, transmit or otherwise process within the Class.
If you have questions or concerns about a Professor’s and/or schools’ decisions regarding the collection and processing of your personal information within a Class on our Platform, you may contact us or the Professor and/or school. If you contact us, we will coordinate the response with the Professor and/or school as appropriate.
Collection and Use of Personal Information.
We collect information about you, including information that directly or indirectly identifies you, through your use of the Platform. We do so:
When you (or other Registered Users) provide the information within the Platform, through filling out forms or otherwise providing information; and
When you correspond with us regarding a Platform subscription or to receive customer support.
This personal information includes:
Registration Information: In order to enable your creation and use of a personalized ecoText account, to validate and track the relationships among schools, Students, Professors and Classes for purposes of Platform administration and security, and to allow us to provide you with messages, notifications and alerts relating to the Platform and with customer support, we collect your name, email address, school affiliation, class year, academic discipline, username, password and similar identifiers.
Payment Information: In order to facilitate payment processing and recordkeeping, we collect details of transactions you carry out through or in relation to our Platform (such as payment of Platform subscription fees) and of the fulfillment of your orders.
User Content: In order to provide the services, features and functionalities that comprise the Platform, we collect data, messages, relationships, text, numbers, formulas, documents, images, photos, audio, video and other information (including annotations, comments, posts, feedback, assignments, assessments) and materials stored, transmitted or otherwise processed by Registered Users within the Platform (“User Content”), which may include personal information.
We use such personal information for the purposes identified above, and more generally to: provide you with information, products or services that you request or that we are otherwise contractually obligated to provide; assist you in implementing our Platform, including setting up accounts and perform consulting services; provide you with support and training; complete transactions (including sending invoices and collecting payments); comply with our legal and security obligations with respect to operating the Platform; improve our products, services, and operations; personalize and continually improve user experience on the Platform; market our products and services; perform statistical, demographic and marketing analyses of users; and facilitate our other legitimate business purposes, including managing our security obligations with respect to the Platform and complying with applicable laws and regulations.
Sharing of Personal Information.
We may disclose or transfer personal information that we collect or you provide as described in this Privacy Notice: (i) to contractors, service providers, and other third parties we use to support our business, in particular providing data hosting, infrastructure and analytics services, and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them; (ii) to other Registered Users, consistent with the Platform’s applicable configurations; (iii) to fulfill any other purpose disclosed by us when you provide the information or consented to by you; (iv) with our affiliates or any successor to all or part of our business; (v) in order to comply with a subpoena, court order, or applicable law; and (vi) in order to protect the rights, property, or personal safety of users, us, or the public.
Retention and Deletion of Personal Information.
This section of the Privacy Notice does not apply to aggregated or de-identified user data that cannot reasonably be used to identify you. We may retain your personal information for the duration of your use of or access to our Platform. We may retain your personal information for longer as necessary and relevant to our legitimate operations in accordance with applicable laws.
Your Choices and Rights.
You have choices and rights with respect to how we collect and use your personal data.
Rights and Requests: You can contact us at any time using the contact information listed in the last section of this Privacy Notice to request we do any of the following: (i) erase or delete all or some of your personal information; (ii) change, update, or correct your personal information; (iii) restrict how we use all or some of your personal information; (iv) access your personal information and, where applicable and feasible, request to receive that information in a commonly used electronic format (or ask for this information to be provided in that format to a third party); or (v) disclose what personal information we collect, use, disclose or sell. We will consider and respond to any such requests promptly and otherwise in accordance with applicable laws.

With respect to our compliance with California law, we do not sell personal information, and we disclose personal information only to the categories of third parties described above under “Sharing of Personal Information.”

We will only process your personal information to the extent applicable law allows us to do so.
The United States has not sought nor received a finding of “adequacy” from the European Union under Article 45 of the GDPR. We rely on derogations for specific situations as set forth in Article 49 of the GDPR. In particular, we collect and transfer personal information to the U.S. only: with your consent; to perform a contract with you; or to fulfill a compelling legitimate interest in a manner that does not outweigh your rights and freedoms.
